Terms of Service

1. Introduction and Acceptance
These Terms of Service ("Terms") govern your access to and use of the iMuvi platform at imuvi.live and our mobile application (collectively, the "Platform"), operated by iMuvi ("we", "us", or "our").
These Terms must be read with our Privacy Policy. By registering or using the Platform you agree to be bound by these Terms. These Terms are subject to the Consumer Protection Act, 68 of 2008 ("CPA") and the Electronic Communications and Transactions Act, 25 of 2002 ("ECTA").
2. Eligibility
You must be at least 13 years of age to use the Platform. Users between 13 and 18 may only use the Platform with the consent and supervision of a parent or legal guardian.
3. Account Registration and Security
- Provide accurate, complete, and current registration information
- Maintain the security and confidentiality of your login credentials
- Not share your account with any other person
- Notify us immediately at shaun@imuvi.live if you suspect unauthorised access
- Accept responsibility for all activity under your account
4. Use of the Platform
You agree not to upload or transmit content that infringes intellectual property rights, is defamatory, hateful, or illegal, contains nudity or graphic violence, or disrupts or damages the Platform.
5. Creator Content and Licensing
You retain ownership of content you create and upload. By uploading content, you grant iMuvi a non-exclusive, royalty-free, worldwide licence to host, store, reproduce, display, and promote your content on the Platform. You warrant that you own or have rights to all content you upload and that it complies with South African law.
6. Content Moderation
All creator content is subject to moderation review. We reserve the right to remove content that violates these Terms. Creators will be notified of moderation actions and may contact us at shaun@imuvi.live to dispute a decision.
7. Coins, Payments, and Virtual Currency
- Coins have no monetary value and cannot be exchanged for cash or transferred
- Coins are non-refundable except as required by the CPA
- Unused Coins remain valid for as long as your account is active
- We reserve the right to modify Coin pricing with reasonable notice
- On account termination, unused Coins are forfeited unless otherwise required by law
8. Intellectual Property
The iMuvi name, logo, and all Platform software and design are the intellectual property of iMuvi. You may not reproduce, distribute, or create derivative works without our prior written permission.
9. Availability and Changes
We aim to keep the Platform available at all times but do not guarantee uninterrupted access. We may modify or discontinue any part of the Platform with reasonable notice.
10. Disclaimer of Warranties
The Platform is provided "as is". To the fullest extent permitted by South African law, we disclaim all warranties, express or implied.
11. Limitation of Liability
To the fullest extent permitted by the CPA, iMuvi shall not be liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the greater of the amount you paid to iMuvi in the preceding 12 months or R500. Nothing limits liability for death or personal injury caused by our negligence.
12. Termination
You may close your account by contacting us at support@imuvi.live. We may suspend or terminate your account for material breach of these Terms.
13. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Disputes are subject to the exclusive jurisdiction of the South African courts.
14. Changes to These Terms
We may update these Terms from time to time with reasonable notice to registered users. Continued use of the Platform after changes take effect constitutes acceptance.
